The Competition Commission of Mexico has recently confirmed its preliminary analysis on market power in the market for the termination of calls in mobile networks. The decision has attracted a lot of attention in the local press since the competition authority concluded that several of these mobile operators have market power for the termination of calls in their respective networks.
The decision paves the way for the imposition of “specific” regulatory obligations by the Federal Telecommunications Commission, the regulatory body for the telecommunications and broadcasting industries in Mexico.
It is highly likely that this decision will be appealed by the firms involved: first, by asking the competition authority to re-evaluate the content of its decision and, second, by appealing in tribunals as a last resort.
